What is EB-5
EB-5 is an immigration program for investors. By investing capital in a US business that creates jobs, you, your spouse and your unmarried children under 21 can obtain Green Cards. No employer and no English proficiency are required.
Main requirements
- An investment of $800,000 in a project in a targeted employment area (TEA) or an infrastructure project, or $1,050,000 otherwise (amounts under the EB-5 Reform and Integrity Act of 2022, periodically adjusted);
- Creation of at least 10 full-time jobs for US workers;
- Documented lawful source of all invested funds;
- The funds must be at risk — a guaranteed return is not allowed.
Two ways to invest
- Through a regional center — an investment in an existing project; jobs can be counted indirectly. The most popular option.
- Direct investment — in your own business that you actively develop and where you create the jobs yourself.
What the process looks like
- Choosing a project and structuring the investment;
- Form I-526E (regional center) or I-526 (direct investment);
- A conditional 2-year Green Card;
- Form I-829 to remove conditions — and a permanent Green Card.
How we help
- We explain the program and help you assess whether it suits you;
- We help you understand the project options and what to look out for;
- We systematically gather and structure source-of-funds documents — the hardest part of EB-5;
- We support the preparation of materials at every stage.
Frequently asked questions
Is the invested money returned?
The law requires the investment to be at risk, so a return cannot be guaranteed. Repayment terms depend on the specific project and must be reviewed carefully.
Can I invest borrowed or gifted funds?
In certain cases, yes, but the source of such funds must also be documented in detail. This is assessed individually.
