EB-1B and EB-1C — researchers and multinational managers

A first-preference Green Card for outstanding professors and researchers (EB-1B) and executives of multinational companies (EB-1C). The petition is filed by a US employer; PERM is not required.

Two first-preference categories

EB-1B and EB-1C belong to the first, highest-priority preference (EB-1). Unlike EB-1A, the petition is filed by a US employer, but PERM labor certification is not required.

EB-1B — outstanding professors and researchers

  • International recognition as outstanding in a specific academic field;
  • At least 3 years of teaching or research experience in that field;
  • An offer of a permanent position (tenure / tenure-track or a permanent research position) from a US university or research organization;
  • Meeting at least 2 of 6 criteria: awards, association membership, published material about your work, peer review, original scientific contributions, scholarly articles.

EB-1C — multinational managers and executives

  • At least 1 year in a managerial or executive position within the last 3 years at a company outside the US;
  • The US company is the parent, subsidiary, branch or affiliate of the foreign company;
  • You are transferring to the US to a managerial or executive position as well;
  • The US company has been doing business for at least 1 year.

EB-1C is often considered by business owners and executives who are opening or expanding a company office in the US.

How we help

  1. Assessment of your profile and the structure of the company or position.
  2. Strategy: which category is realistic for you and on what grounds.
  3. Evidence: recognition, publications, organizational structure, duties, finances.
  4. Individual PR to strengthen professional recognition (especially for EB-1B).
  5. Package preparation together with the employer and a final review.

Frequently asked questions

Can I file EB-1B or EB-1C myself?

No, in both categories the petition is filed by a US employer. If you do not have an employer, consider EB-1A or EB-2 NIW.

Is EB-1C suitable for a small business owner?

Possibly, if the foreign and US companies are genuinely related and doing business, and you perform truly managerial or executive functions. This requires a careful assessment of the business structure.
