EB-2 and EB-3 — Green Card through an employer

Employment-based immigration for specialists with a US job offer: from PERM labor certification to the I-140 petition and a Green Card. We help you navigate every stage and prepare the materials.

How it works

EB-2 and EB-3 are the classic path to a Green Card through a US employer. The employer offers you a permanent job and goes through a procedure proving that no qualified US workers are available for the position.

Main stages

  1. Prevailing wage — the US Department of Labor (DOL) sets the minimum wage for the position.
  2. Recruitment and PERM — the employer tests the US labor market and files the labor certification.
  3. I-140 petition — after PERM approval, the employer files the immigrant petition with USCIS.
  4. The queue (Visa Bulletin) — waiting until your priority date becomes current.
  5. Green Card — through adjustment of status in the US (I-485) or through a consulate.

EB-2 or EB-3

  • EB-2 — positions requiring an advanced degree (or a bachelor’s + 5 years of experience) or exceptional ability;
  • EB-3 — skilled workers (at least 2 years of experience or training), professionals with a bachelor’s degree, and other workers.

How we help

  • We assess your profile and how realistic the employer route is;
  • We explain the process and the timeline of each stage;
  • We help prepare documents proving your education and experience;
  • We coordinate the preparation of materials between you and the employer.

Because the PERM procedure and the petition are officially handled by the employer together with its attorney, the timelines here are much longer than for self-petitions and depend on the Department of Labor and visa backlogs.

Frequently asked questions

Can I get a Green Card through an employer without PERM?

In the EB-2 and EB-3 categories, PERM is required. Without PERM, you can apply under EB-2 NIW or EB-1.

Who pays for PERM?

Under Department of Labor rules, the costs of PERM labor certification (including recruitment) must be borne by the employer.
